Housing and moving after separation

Separating raises two housing questions: who can stay in the family home, and where the other person will live. Free advice from Shelter explains your rights to the home. Mortgage brokers, removal firms and storage companies help once you know what you are doing next.

When should you get housing advice?

Get advice before anyone moves out. In England and Wales, if you are married or in a civil partnership and the home is in your spouse's name, you have "home rights" to stay there and can register them with HM Land Registry (GOV.UK). If you aren't married, your rights depend on whose name is on the deeds or tenancy, so get advice early.

How much does moving cost?

Housing advice from Shelter and the Northern Ireland Housing Executive is free. Some mortgage brokers charge you no fee because the lender pays them, while others charge you directly, so ask before you start. Removal and storage prices depend on how much you are moving and how far.

How to choose the right help

If you want to keep the house, speak to a mortgage broker early to see whether you could take on the mortgage alone, as lenders will look at your income on its own. Get more than one removal quote and check what insurance is included.
