Wills and life admin after divorce

In England and Wales, divorce does not cancel your will. Once the final order is made, your will is read as if your former spouse had died, so they lose any gift and can't act as executor, unless your will says otherwise (Wills Act 1837). Separation on its own changes nothing, so review your will as soon as you separate.

When should you update your will?

Review your will when you separate, again when the divorce is final, and if you remarry, because marriage cancels any will you made before (GOV.UK). Check the rest of your paperwork at the same time, including pension nominations, life insurance beneficiaries and who you have named as next of kin. The rules on wills don't change these.

How much does a will cost?

Online will services and solicitors charge fees that depend on how complicated your situation is. Each provider here publishes its prices, so compare what is included, such as storing the will and making changes later.

What to tell your will writer

If your divorce is still going on, say so, because what you can leave may depend on your financial settlement. Until that settlement is final, a former spouse may still be able to claim against your estate (Wills Act 1837, section 18A). Scotland and Northern Ireland have their own rules, so get advice there.
